By using the Site, you confirm that you accept and agree to comply with these Terms. The Terms may be amended from time to time. They were last updated on 23 May 2018.

These Terms are applied in conjunction with our Privacy Policy, which sets out how we use cookies and any personal data that you provide to us. By using our site, you consent to such use and agree that all data provided by you is accurate.

 

Updates to the website

EROL may update and enhance the Site from time to time to upgrade the resources in order to best provide for the needs of students and schools, or as required due to changes in applicable laws or regulations.

 

Access to the website

We do our utmost to ensure uninterrupted access to the Site is available 24/7, 365 days per year. However, access to the Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

We cannot be held responsible if for any reason the Site is unavailable at any time or for any period. We reserve the right to suspend access at any time for operational, regulatory, legal or other reasons. We will do our best to give you reasonable notice of any suspension.

 

Subscription and payment

It is necessary to register on the Site in order to access the resources. Some of the resources are free to access. Additional resources require a single annual subscription payment. Subscriptions expire on 30 June each year. We do not auto-renew subscriptions.

All payments for individual access made through the Site are subject to and include UK VAT. Payment can be made by any method of payment shown on the checkout page. All individual subscriptions are final and non-refundable unless faulty. Access to the resources begins immediately upon payment. We will send you an email notification of every valid subscription, but we cannot guarantee that the email will be received by you.

 

Security of account details

On registration you will select a username and password. You must keep your username and password secure and must treat this information as confidential. You must not disclose it to anyone else. We reserve the right to disable any username, or reset any password, if we believe that it is no longer secure or if in our reasonable opinion you have failed to comply with these Terms.

You will be responsible for all activities and orders under your password. If you know or suspect that someone else has your account details, you must inform us at support@my-GCSEscience.com. If you forget your password, please use the reset password feature on the Site.

 

Intellectual property rights: how you may use the Site

EROL is the exclusive owner or the licensee of all intellectual property rights in the Site and of the material published on it.

All accounts set up on the Site are for individual users and are non-transferable. These accounts must not be shared within schools. If you wish to have access for more than one student and/or teacher in your school, you must either buy multiple individual subscriptions or purchase a school subscription by contacting schools@my-GCSEscience.com.

You may not distribute our resources over a network where it could be used by multiple devices at the same time. We may suspend access to the Site if we find that access has been obtained by the use of the same password from more than one IP address on three or more occasions.

You may draw the attention of others within your school to the contents of the Site. EROL’s ownership of the content of the Site must always be acknowledged. Documents may be copied for personal use only, in accordance with these Terms, on the condition that source indications are also copied, no modifications are made and the document is copied entirely. You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so. If you print off, copy or download any part of our site in breach of these terms, your right to use our site will cease immediately and you must destroy any copies of the materials you have made.

You may link to the Site, provided you do so in a way that is fair and legal and does not damage or exploit our reputation. EROL reserves the right to withdraw linking permission without notice. If you wish to link to or make any use of content on our site other than that set out above, please contact support@my-GCSEscience.com.

Except as expressly provided in these Terms, no part of the Site may be copied or reproduced in any manner. You must not use any automatic device or manual process to access, acquire, copy or monitor any portion of the Site, or in any way reproduce or circumvent the navigational structure or presentation of the Site. You must not modify, assign, transfer, redistribute or sub-license any of the videos or services available through the Site. You must not decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the software or the Services available through the Site, except to the extent permitted by applicable law. The use of any part of the Site, except as permitted in these Terms, is strictly prohibited and may result in the infringement of the intellectual property rights of others, subjecting you to civil and criminal penalties for copyright infringement.

You agree that you will not use the Site or any of the Services available through the Site for any purpose prohibited by any applicable law in your country of residence. You must not use the Site in any manner that could damage, disable, impair or overburden the Site or attempt to gain unauthorised access to any part of the Site through hacking, password mining or any other means.

You will be responsible for any losses and costs resulting from your breach, or breach by anyone for whom you are responsible, of these Terms. If you access the Site from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws. We may terminate your use of the Site with immediate effect if you breach any of these Terms.

Governing law and jurisdiction

These Terms are governed by English law, and you and we agree to submit to the jurisdiction of the English courts.
